Why register a trade mark?

Avoid infringement and lawsuits

In early days, small business owners are usually very busy working on sales. There isn\\\’t much time to thoroughly check for conflicting brands, especially in faraway places or related fields. But a good search by a professional attorney, followed by a registered trade mark, will protect you from a lawsuit when you can least afford it.

Stop copycats and counterfeits

When you register a trade mark, you get certain rights under the Trade Marks Act 1995. For example, you gain exclusive use of your trade mark in Australia for your specified goods and services. You also gain the right to assistance from Customs (Australian Border Force) against imports of counterfeits from overseas.

Secure your business’s growth

When it’s time to expand your business or sell it, lenders and buyers will insist on ‘due diligence’ to confirm all is in order. Having registered your trade marks will make this go more smoothly. Remember, a trade mark takes at least 7.5 months from filing to grant. You don’t want that sort of delay when seeking finance or a sale.
